Rensselaer County legislators push for stricter Vt. sex laws
TROY - In the wake of the alleged abduction and murder of 12-year-old Brooke Bennett in Randolph, Vt., in late June, two Rensselaer County legislators are championing a campaign to strengthen sex offender laws in the neighboring state.
Bennett's uncle, Michael Jacques, a registered sex offender, has been accused of kidnapping Bennett prior to her murder. Her body was found in a shallow grave near Jacques' home a short time after she went missing.
Vermont Lt. Gov. Brian Dubie has himself called for reform of sex offender laws in his own state and has started a petition drive to that end. The petitions are already being circulated in the Route 22 corridor.
Rensselaer County legislators Stan Brownell and Lester Goodermote this week announced their intention to introduce a resolution at the Aug. 12 legislative session calling for stricter laws for sexual predators in Vermont.
"Vermont has been known for having weak sex offender laws and lenient sentencing for sex offenders," Brownell said. "That presents a potential public safety risk for the communities we represent in eastern Rensselaer County."
"We want to see state leaders in Vermont passing laws that get tough with sex offenders and prevent future tragedies. They need to recognize that they have a responsibility to help protect this region," said Goodermote.
Brownell and Goodermote are responding to concerns expressed by their constituency and plan to join Dubie's petition-circulating efforts along Route 22 in the coming days.
"We hope our resolution sends a very clear message that Vermont's lenient sex offender laws need to be reformed.
There is already a movement in the state to reform existing laws and we hope our resolution helps those efforts," added Brownell.
In a telephone interview with The Record Thursday, Dubie said he would welcome the chance to sit down with Brownell and Goodermote to discuss ways to enhance laws designed to make children safer.
"I'd like to talk to them directly before I read about a resolution in the paper. I will drive to Albany or to Troy to meet with these legislators and anyone else who wants to share ideas that will make all of our children safer," he said. "I have a telephone. All they have to do is call me and I'll be there."
Brownell and Goodermote plan to reach out to Dubie by phone this week, said their spokesperson Richard Crist.
Dubie, a father of four children, lauded the zero-tolerance policies embraced by state Attorney Gen. Andrew Cuomo and Gov. David Paterson with regard to sex crimes against children in New York.
He is calling for a system-wide investigation of his own state's criminal justice system in an effort to discover why sex abusers of children find ways to re-offend in Vermont.
Dubie's reform likewise calls for an enhanced sex offender registry that complies with new federal mandates, civil confinement legislation that mirrors that of New York, and a 25-year mandatory minimum prison sentence for a first-time convicted sex abuser of children.
Several years ago U.S. Sen. Charles Schumer, D-N.Y., introduced legislation to create a National Sex Offender Registry, which was enacted in July 2005.
At the time, Schumer and his colleagues in the Senate recognized that a national approach was needed to make it harder for released pedophiles and rapists to commit crimes again simply by moving across state lines.
