In Columbus, the Ohio Supreme Court on Monday set a December execution date for a man convicted of raping and killing a Cincinnati woman more than 20 years ago.
Jerome Henderson is scheduled to die Dec. 5 for the 1985 slaying of Mary Acoff, 26.
Henderson, 45, was convicted of aggravated murder, burglary and attempted rape in the attack on Acoff. Acoff had fought with her attacker and was beaten and repeatedly stabbed. Her body was found in her apartment.
In July 2003, U.S. District Judge S. Arthur Spiegel set Henderson's death sentence aside based on an appeal of his conviction because of faulty instructions to the jury. In June, a 3-judge panel of the 6th U.S. Circuit Court of Appeals in Cincinnati overturned that ruling.
Earlier this month the appeals court denied Henderson's request for a hearing by the full court. Lawyers had also previously challenged Henderson's conviction on the basis that 2003 DNA testing found no evidence of semen in Acoff's body

CINCINNATI -- A federal appeals court late today granted an emergency stay of execution to a convicted murderer who was scheduled to die Tuesday by lethal injection.
A panel of the 6th U.S. Circuit Court of Appeals granted the motion sought by Jerome Henderson, 47, who was convicted in July 1985 of murdering a Cincinnati woman earlier that year.
The Ohio Supreme Court on Thursday had denied Henderson's motion for a stay. The appellate panel, which was split 2-1, gave no explanation of its ruling.
However, Judge Alice Batchelder, wrote in her dissent that she found no basis to grant the stay, which she believed was inconsistent with precedent set in a similar recent case.
David Stebbins, Henderson's attorney, said he expected Attorney General Jim Petro to appeal the stay and ask for a review by the full court. A spokesman for Petro said an appeal was being prepared.
Henderson was convicted of aggravated murder, aggravated burglary and attempted rape in the March 1985 death of 26-year-old Mary Acoff. Prosecutors said he climbed through the kitchen window into Acoff's ground floor apartment and repeatedly stabbed and beat her when she fought his attempts to rape her.
