Saying 27 years on death row without being executed was generous, a Hamilton County judge Friday rejected a unique attempt to spare Daniel Bedford from his scheduled Tuesday execution.
"Enough is enough is enough is enough," Common Pleas Court Judge Norbert Nadel said.
Gov. John R. Kasich on Friday denied a request for clemency.
Attorneys for Bedford, 63, argued Friday before Nadel that Bedford shouldn't be executed because he has dementia and can't remember murdering ex-girlfriend Gwen Toepfert, 25, in a 1984 jealous rage, can't remember also murdering John Smith, 27, who was with Toepfert at the time and can't remember later returning to Toepfert's apartment to fire a shotgun blast into her groin.
"He doesn't understand why the death penalty is being imposed on him," Bedford's attorney Carol Wright said to Nadel.
Ohio law doesn't allow inmates who are "insane" to be executed, she added, because that would negate the message of retribution the execution sends to the murderer and the community.
In addition to having dementia, Bedford, she said, also has had several strokes.
"He's a low-functioning individual," she said.
Assistant Prosecutor Ron Springman, though, said evidence - including Bedford's testimony before the Ohio Parole Board that voted 9-0 to deny him clemency - proves Bedford is mentally advanced enough to be executed.
"He understands what (it means) to be deceased ... He said he would remain calm throughout the execution process," Springman said.
"He fully understands the nature of the death penalty and he fully understands why it was imposed on him."
Bedford has been on death row longer than Toepfert was alive.
The case is believed to be the first time in Ohio that a death row inmate has filed a civil lawsuit to try to stop his execution.
After the hearing, Nadel noted Bedford has been through every court and process available to a death row inmate.
"There's no question he did it," Nadel said. "He has had every possible consideration. Twenty-seven years."
Nadel denied Bedford's request to declare him insane or to set a hearing on the civil case - either of which could have delayed Bedford's Tuesday execution date.
Wright said she "immediately" would appeal Nadel's decision.
